TO: STATE AGENCIES ADMINISTERING CHILD SUPPORT ENFORCEMENT PLANS UNDER TITLE IV-D OF THE SOCIAL SECURITY ACT AND OTHER INTERESTED INDIVIDUALS

SUBJECT: Technical Corrections to Federally Approved Child Support Enforcement Notice of Lien Form

ATTACHMENT: Corrected Notice of Lien form and instructions

REFERENCES: 42 U.S.C. 652(a)(11), 42 U.S.C. 654(9)(E), and 42 U.S.C. 666(a)(4).

BACKGROUND: Section 454(9)(E) of the Social Security Act requires OCSE to promulgate a Notice of Lien form for use in interstate child support enforcement cases. After an updated Notice of Lien form was approved by the Office of Management and Budget, it was disseminated to states and other interested parties in OCSE-AT-01-06, dated April 4, 2001. It was subsequently brought to our attention that there were discrepancies between the wording of the form and the instructions. OMB has approved the attached corrected copy of the form and instructions, which replaces the Notice of Lien form and instructions disseminated in OCSE-AT-01-06. The corrections are summarized below. None are substantive.

CORRECTIONS TO FORM:

Change "CSE" to "IV-D" after FROM.

Add "or entity acting on behalf of the obligee," after "private attorney" in FROM section.

Change "Obligee/Claimant" to "Obligee" wherever it appears.

Capitalize "State" wherever it appears.

In paragraph beginning "All aspects of this lien," change "claimant" to "obligee" in last line.

In Note to Lien Recorder, change "claimant" to "sender".

After A. [ ], change "Issued" to "Submitted" and add "on behalf of the named obligee" after "agency/office."

In paragraph beginning "As an authorized agent," change "state, or subdivision of a State," to "State or Tribal, or subdivision of a State or Tribal," and change "agency (claimant)" to "agency".

In paragraph beginning "I certify," insert "under penalty of perjury that the information contained in this notice is true and accurate and" after "I certify."

In the copy of the form with numbered fields that accompanies the instructions to the form: change "name" to "named" in field 13.

In the instructions to the form: in 3., add "e-mail address," after "address"; in 13., change "issued" to "submitted" both times it appears.

SUPERSEDED MATERIAL: OMB has approved the corrected Notice of Lien form and instructions. The attached, corrected copy of the form supersedes the form that was distributed in OCSE-AT-01-06 on April 4, 2001. The OMB form number and the expiration date remain the same. Notices of Liens currently pending or in use in states to enforce interstate child support cases do not have to be re-issued. States may respond to requests from other states and tribes that used the earlier forms.

ACTION REQUIRED: Begin using the corrected Notice of Lien form upon receipt.
