-----Original Message----- From Dismuke: "... now that Congress has stepped into the picture, SoundExchange is under pressure to negotiate honestly and in good faith - something that it has not done to date..." Sorry, I've got to call BS on this statement. This is opinion and not fact. The representatives of net radio refused to negotiate with SoundExchange and forced a panel of judges to arbitrate the issue. This manufactured "crisis" represents the very essence of bad faith tactics. The Digital Media Association lost before the the arbitration panel, lost before an appeals court and didn't manage to get Congress to actually do anything. Now they are finally sitting down and negotiating. Whoopee! It's about time. They could have done this in good faith by the October 2005 deadline. Instead they chose drama in the hopes that Congress might be manipulated into lowering their rate cap. Free Enterprise just isn't a good enough business model for these folks. Wouldn't it be nice if Congress also put a cap on our housing prices?
