  My child's parent has filed for bankruptcy. Will this affect our ability to obtain child support?
  Answer
  Child support payments cannot generally be discharged in bankruptcy. This means that a person who owes child support cannot escape this duty by filing for bankruptcy. Bankruptcy proceedings may, however, delay receipt of child support payments. You may wish to contact your State child support enforcement office for more information.

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 contains a variety of provisions that will be helpful to States and families seeking to establish paternity and support orders and to enforce child support obligations. The revisions, among other changes:
Allow enforcement of support orders during bankruptcy proceedings;
Give domestic support obligations first priority in distribution of available funds
