Photographs in the G. Eric and Edith Matson Photograph Collection
are in the public domain. However, there are donor restrictions
on the use of the color lantern slides. Privacy and publicity rights may
also apply.
Access: Permitted; subject to P&P policy
on serving originals which requires service of digital surrogates
in lieu of the originals.
Reproduction (photocopying, hand-held camera copying,
photoduplication and other forms of copying allowed by "fair
use"): Permitted;
subject to P&P policy on copying, which prohibits photocopying
of the original photographs in this collection.
Publication and other forms of
distribution: Permitted,
but with donor restrictions on the
use of lantern slides. The Kensington
Episcopal Home conveyed the collection
to the Library in 1978. In 2003,
the Home dedicated the intellectual property
and related rights to the
collection to the American public,
subject to "whatever rights, if
any, that may have previously been
conveyed to others." The Home
had previously given exclusive rights
for the use of lantern slides in
connection with a forthcoming book on
Matson's color
work (to be published
by Overlook Press and tentatively
entitled "The Well of Abraham").
The Home agreed to limit others'
use of the lantern slides in book form
to
a maximum of 25 lantern slides.
The agreement terminates once all editions
of the book go out of print.
