SUBJECT: Approval of Privacy Act Documents; authority delegation

1.  PURPOSE. Treasury Directive (TD) 25-04, “The Privacy Act of 1974, As Amended,” issued March 1, 2000, states policy and assigns responsibilities with respect to the Privacy Act.   Section 5 of TD 25-04 delegates certain authorities to the Chief Management and Administrative Programs Officer.  That position has been discontinued.  The purpose of this TD 12-54 is to reassign certain duties and authorities until a successor edition of TD 25-04 is issued.

2. DELEGATION. By virtue of the authority vested in the Assistant Secretary for Management and Chief Financial Officer by Treasury Order (TO) 101‑05, I hereby delegate to the Deputy Assistant Secretary Headquarters Operations the authority to approve, on behalf of the Department, subject to Treasury Directive (TD) 28‑01, the notices, determination and regulations required to be published by the Privacy Act of 1974, as amended. This includes the authority to ratify, where necessary, any such notice, determination or regulation previously issued.

3. REDELEGATION. The authority delegated in section 2 may not be redelegated. During the absence of the Deputy Assistant Secretary Headquarters Operations, any required notices, determinations and regulations shall be approved by the Assistant Secretary for Management and Chief Financial Officer, or by another Deputy Assistant Secretary designated for that purpose by the Assistant Secretary for Management.

4.  OTHER RESPONSIBILITIES.  The Deputy Assistant Secretary Headquarters Operations also shall carry out those functions relating to the Departmental Offices that were assigned to the Chief Management and Administrative Programs Officer by section 5.d of TD 25-04, issued March 1, 2000.

5. AUTHORITY. TO 101‑05, "Reporting Relationships and Supervision of Officials, Offices and Bureaus, Delegation of Certain Authority, and Order of Succession in the Department of the Treasury."

6. REFERENCES.

7.  CANCELLATION.  Section 5.b of TD 25-04, issued March 1, 2000, is superseded until a successor edition of TD 25-04 is issued.

8. EXPIRATION DATE. This Directive expires three years from January 15, 2004, unless superseded or cancelled prior to that date.
