PRESIDENT’S COMMITTEE FOR PEOPLE
WITH INTELLECTUAL DISABILITIES
(Formerly President's Committee on Mental Retardation)
PURPOSE
The President's Committee on Mental Retardation, now known
as the President's Committee for People with Intellectual
Disabilities (PCPID), was originally established by
Executive Order 11280 on May 11, 1966. Executive Order
11280 was superseded by Executive Order 11776 on March 2 8 ,
1974, and Executive Order 11776 was superseded by Executive
Order 12994 on March 21, 1996. Executive Order 12994 was
continued by Executive Order 132 25 signed on September 28 ,
2001, which continued the Committee through September 30,
2003. On July 25, 2003, Executive Order 12994 was amended
by a change in name from the President's Committee on
Mental Retardation to the President's Committee for People
with Intellectual Disabilities with expanded membership and
continued through September 30, 2005. Executive Order
12994 as amended was continued by Executive Order 13446 on
September 28, 2007, which continues the Committee through
September 30, 2009. The PCPID provides advice to the
President and to the Secretary of Health and Human Services
concerning a broad range of topics relating to people with
intellectual disabilities.
AUTHORITY
Executive Order 12994, dated March 21, 1996, was continued
by Executive Order 13062, dated September 29, 1997, and
subsequently continued by Executive Order 13138, dated
September 30, 1999, which was subsequently continued by
Executive Order 13225, dated September 28, 2001, continuing
the Committee through September 30, 2003. Executive Order
12994 was amended on July 25, 2003, continuing the
President's Committee on Mental Retardation under a new
name as the President's Committee for People with
Intellectual Disabilities with expanded membership through
September 30, 2005. Executive Order 12994 as amended was
continued by Executive Order 13385 through September 30,
2007. Executive Order 12994 as further amended was
continued by President George W. Bush through Executive
Order 13446 issued on September 28, 2007, effective through
September 30, 2009.
The Committee is governed by Public Law 92-463, the Federal
Advisory Committee Act, as amended, (5 U.S.C., Appendix 2),
which sets forth standards for the formation and use of
Federal advisory committees.
FUNCTION
In keeping with Executive Order 13446 as issued September
28, 2007, and consistent with Executive Order 12994 as
amended, the Committee shall:
- Provide such advice concerning intellectual
disabilities as the President or the Secretary of Health
and Human Services may request; and
- Provide advice to the President concerning the
following for people with intellectual disabilities:
- Expansion of educational opportunities;
- Promotion of homeownership;
- Assurance of workplace integration;
- Improvement of transportation options;
- Expansion of full access to community living; and
- Increasing access to assistive and universally
designed technologies.
The Committee shall provide an annual report to the
President through the Secretary of Health and Human
Services. Such additional reports may be made as the
President may direct or as the Committee may deem
appropriate.
The members shall advise the President and carry out their
advisory role consistent with the requirements of the
Federal Advisory Committee Act , a s amended (5 U.S.C. App.) .
STRUCTURE
The Committee shall be composed of the following members:
- The Attorney General ;
- The Secretary of Interior;
- The Secretary of Commerce;
- The Secretary of Labor;
- The Secretary of Health and Human Services;
- The Secretary of Housing and Urban Development;
- The Secretary of Transportation;
- The Secretary of Education;
- The Secretary of Homeland Security;
- The Chief Executive Officer of the Corporation for National and
Community Service;
- The Commissioner of Social Security;
- The Chair of the Equal Employment Opportunity Commission;
- The Chairperson of the National Council on Disability ; and
-
No more than 21 other members who shall
be appointed to the Committee by the President.
These citizen members shall consist of individuals
who represent a broad spectrum of perspectives, experience,
and expertise on intellectual disabilities; persons with
intellectual disabilities and members of families with a
child or adult with intellectual disabilities; and persons
employed in either the public or the private sector.
Except as the President may from time to time otherwise
direct, appointees under this paragraph shall serve for
two-year terms, except that an appointment made to fill
a vacancy occurring before the expiration of a term shall
be made for the balance of the unexpired term.
The President shall designate the Chair of the President's
Committee for People with Intellectual Disabilities from
the 21 citizen members. The Chair shall preside over
meetings of the Committee and represent the Committee on
appropriate occasions.
The Department of Health and Human Services shall provide
the President's Committee for People with Intellectual
Disabilities with necessary staff, administrative services
and facilities, and funding, to the extent permitted by
law.
MEETINGS
Meetings of the President's Committee for People with Intellectual
Disabilities shall be held approximately four times a year and may
be held by conference call, at the call of the Chair, or Vice Chair,
with the advance approval of a Government official, who shall also
approve the agenda. A Government official shall be present at all
meetings.
Meetings shall be open to the public except as determined otherwise
by the Secretary or other official to whom the authority has been
delegated; notice of all meetings shall be given to the public.
Meetings shall be conducted, and records of the proceedings kept,
as required by applicable laws and Departmental regulations.
COMPENSATION
Each member of the President's Committee for People with
Intellectual Disabilities, except any member who receives
other compensation from the United States Government, may
receive compensation for each day he or she is engaged in
the work of the Committee, as authorized by law (5 U.S.C.
3109), and may also receive travel expenses, including per
diem in lieu of subsistence, as authorized by law (5 U.S.C.
5701-5707), for persons employed intermittently in the
Government service. Committee members with disabilities
may be compensated for attendant expenses, consistent with
Government procedures and practices. The compensation for
members will be adjusted downward whenever quarterly
meetings are conducted via teleconferencing.
ANNUAL COST ESTIMATE
The estimated annual cost for operating the President's
Committee for People with Intellectual Disabilities,
including compensation and travel expenses for members to
attend Committee meetings, but excluding staff support, is
projected at $43,500 subject to the availability of funds.
The estimated annual FTEs (Full Time Equivalent) are five
at a cost of up to $633,523.
REPORTS
The President's Committee for People with Intellectual
Disabilities shall make an annual report to the President
concerning intellectual disabilities through the Secretary
of Health and Human Services. Such additional reports may
be made as the President may direct or as the Committee may
deem appropriate.
TERMINATION DATE
Unless renewed by appropriate action prior to its
expiration, the President's Committee for People with
Intellectual Disabilities will terminate on
September 30, 2009.
