PORTLAND, Ore. — The U.S. Army Corps of Engineers is seeking comments on an application for a permit to conduct work in waters of the United States. The public notice regarding this permit application was issued during the week of Aug. 14, 2008.
Public Notice NWP-2008-188 describes a proposal by the Oregon Department of Transportation to discharge fill into 1.286 acres of wetlands and 0.04 acre of a tributary to Tolman Creek in order to construct a rest area along Interstate 5 in Ashland, Ore.
The applicant proposes to purchase credits from the ODOT Vernal Pool Mitigation Bank to compensate for the project’s impacts.
The Corps is soliciting comments on this proposal from the public; federal, state and local agencies; Indian Tribes; and other interested parties. The public notice which provides more information is available at http://www.nwp.usace.army.mil/op/g/public.asp. Comments must be received by Sept. 15.
The Corps issues or denies permits under authority of Section 404 of the Clean Water Act for discharge of dredged or fill material into U.S. waters, and/or Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.
