PORTLAND, Ore. — The U.S. Army Corps of Engineers is reviewing an application for a Department of the Army permit to conduct work in waters of the United States. The public notice regarding this permit application was issued during the week of Jan. 27, 2008.
Public Notice NWP-2007-841 describes a proposal by Hendgen-McMinnville LLC to build a residential subdivision, access roads and detention/water quality facility in Albany, Ore.
The proposed project would impact 1.93 acres of wetlands and 0.05 acre of a stream channel. The Corps will determine if the applicant’s proposal to enhance on-site wetlands and purchase wetland mitigation bank credits is appropriate and practicable compensatory mitigation.
The Corps is soliciting comments on this proposal from the public; federal, state and local agencies; Indian Tribes; and other interested parties. Comments must be received by Feb. 28. The public notice which provides more information is available at http://www.nwp.usace.army.mil/op/g/public.asp.
The Corps issues or denies permits under authority of Section 404 of the Clean Water Act for discharge of dredged or fill material into U.S. waters, and Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.
