Corps reviews permit applications for Marion, Linn and Polk counties

PORTLAND, Ore. -- The U.S. Army Corps of Engineers is reviewing three applications requesting a Department of the Army permit for certain work in waters of the United States. The public notices regarding the permit applications listed here were issued during the week of

Sept. 3.

Public Notice NWP-2007-817, requested by JCNW Family, LLC, is for a project located west of Kindle Way and north of Hummingbird Lane near Stayton in Marion County, Ore. The proposed project is to construct a residential subdivision and will permanently fill 0.69 acre of potentially isolated wetlands and temporarily impact 0.14 acre of wetlands. Fill material to construct roads, sidewalks and residential lots for the subdivision would be placed in 0.64 acre of wetlands. Additional impacts would occur during construction of the sanitary sewer and stormwater utility lines. A swale would be constructed that would permanently impact 0.04 acre of wetlands and would run parallel to the existing east-west and north-south drainage ditches, ultimately discharging to Mill Creek. The applicant has proposed to provide compensatory mitigation for the unavoidable impacts by purchasing 0.69 credits at the Mud Slough Mitigation Bank. If a permit is issued, the Corps will determine appropriate and practicable compensatory mitigation. Comments must be received by Oct. 4.

Public Notice NWP-1994-729, requested by Oregon Parks and Recreation Department, is located at Calapooia River Mile 28.5, about a half mile south of Linn West Road near Brownsville, in Linn County, Ore. The applicant proposes to dredge about 200 cubic yards of gravel from the Calapooia River each year for the next five years to maintain adequate river flow for fish enhancement. The applicant will access the east river bank from an existing gravel road and the west bank by crossing farm fields. Equipment required for the work includes a track excavator, a front end loader, a crane and dump trucks. The applicant proposes to construct a small push up berm at the water’s edge to minimize turbidity. Dredged material will be placed in an upland area offsite. The applicant states there will be no return water. If a permit is issued, the Corps will determine appropriate compensatory mitigation equal to the anticipated impacts of the project. Comments must be received by Oct. 9.

Public Notice 2007-699, is a proposal to establish an 80-acre phase of an existing wetland mitigation bank. The site is located near Greenwood Road, north of Highway 22 and east of Baskett Slough National Wildlife Refuge, in Polk County, Ore. The mitigation bank sponsor proposes to restore and enhance additional wetlands adjacent to his existing Mud Slough Mitigation Bank phases one and two and Wetland Reserve Program holdings. Phases one and two of Mud Slough Mitigation Bank were approved in 2000 and 2004 respectively. The proposed phase three would generate wetland credits by converting drained and farmed wetland to emergent, prairie, shrub and forested wetlands dominated by native plants. Existing drain tiles and ditches would be disabled or filled, and low berms would be created to impound rainfall on the site. A prospectus describing the proposed phase three of the bank is now available for public review at http://statelandsonline.com. Phase three is being proposed primarily as a means to meet the requirements for compensatory mitigation for projects which may be permitted by the Corps and the Department of State Lands. The bank sponsors would sell wetland credits to various parties to meet their obligations under the “no net loss of wetlands” policies of federal and state regulations. Comments must be received by Oct. 8.

The Corps of Engineers is soliciting comments from the public, federal, state and local agencies, Indian Tribes and other interested parties on these permit requests. The Corps will issue or deny any permit under authority of Section 404 of the Clean Water Act, for discharge of dredged or fill material into U.S. waters, and/or under Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.
