Corps reviews permit applications from Brookings and Winston, Ore.

PORTLAND, Ore. — The U.S. Army Corps of Engineers is reviewing two applications requesting a Department of the Army permit for certain work in waters of the United States. The public notices regarding the permit applications listed here were issued during the week of Jan. 22, 2007.

Public Notice NWP-2006-9105, requested Mahar Kessler Properties. The project is located on an unnamed tributary of Fish House Creek in Brookings, Ore. The applicant proposes to prepare the site for a residential development, including access roads and constructing an earthen dam for sediment/stormwater retention. The proposed actions would impact 300 linear feet in one location and 150 linear feet in second location of the unnamed tributary. Comments must be received by Feb. 24, 2007. Public Notice NWP-2007-48. The project is located in wetlands adjacent to and unnamed tributaries of Lookingglass Creek in Winston, Ore. The applicant proposes developing a 46-lot residential subdivision and associated infrastructure. Up to 0.72 acre of wetlands would be impacted, and one through-road impacting wetlands would be needed for access to the site. Comments must be received by Feb. 24, 2007. The Corps of Engineers is soliciting comments from the public, federal, state and local agencies, Indian Tribes and other interested parties on these permit requests.

The Corps of Engineers will issue or deny any permit under authority of Section 404 of the Clean Water Act, for discharge of dredged or fill material into U.S. waters, and/or under Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.

If the applicants have submitted a mitigation plan with the permit request, it will be considered.

If a permit is issued, the Corps will decide on the appropriate and practicable compensatory mitigation for each proposed project.
