Jurisdictional Determinations

A jurisdictional determination (JD) is the process of identifying and locating jurisdictional Waters of the United States (including wetlands) regulated by the U.S. Army Corps of Engineers (COE) under Section 404 of the Clean Water Act. The method of performing a (JD) employs a multi-parameter approach defined in Technical Report Y-87-1, Corps of Engineers Wetlands Delineation Manual, dated January 1987. It requires positive evidence of hyrophytic vegetation, hydric soils, and wetlands hydrology for a determination that an area is a wetland.

The wetland delineation process establishes a line that separates and identifies the wetland areas from non-wetland (upland) areas. The wetland delineation and (JD) provides important information to a landowner or investor for planning purposes or carrying out certain activities on a given parcel of land. It is essential in making an application for a permit from the COE to determine if work would occur in wetlands or navigable waters of the United States.

The Charleston District issues thousands of (JDs) annually. As a service to the public, the District will report on a weekly basis (JDs) issued, including the standardized reporting forms used for making the determinations, on this website.
