The US Army Corps of Engineers, Little Rock District, announces the publication and one-year trial implementation period of the Atlantic and Gulf Coastal Plain Interim Regional Supplement (Supplement) to the 1987 Wetland Delineation Manual (1987 Manual). This Supplement was developed by wetland delineation experts from state and Federal agencies and academia with experience within the Atlantic and Gulf coastal plain region. It has been peer reviewed by an independent panel of scientists and practitioners and made available for a 90-day public comment period. This interim document will be tested for one year prior to finalization; the one-year period will be effective 30 days from the date of this public notice. The supplement will be field tested by interagency teams of state and Federal scientists to assess its clarity and ease of use, and to determine whether its use will result in any spatial changes in wetland delineation for Clean Water Act purposes.

Pine Bluff Sand & Gravel Company has requested authorization for the placement of dredged and fill material in waters of the United States associated with the continuation of their commercial sand and gravel dredging operations. The current permitted removal limits are located on the Arkansas River between Navigation Miles 93.9 and 87.4, between Navigation Miles 85.5 and 66.6, and in Lake Langhofer from Pine Bluff Harbor miles 0.0 to 7.5. These areas are in Jefferson and Pulaski Counties, Arkansas.
Dredging operations have been permitted in these reaches since 1962.

In accordance with Title 33 CFR 325.2 and 325.7(e), as published in the November 13, 1986, Federal Register, the Kansas City District, U.S. Army, Corps of Engineers (as lead district), in conjunction with the Rock Island District, St. Louis District, Memphis District, and Little Rock District proposes to renew an existing general permit and extend the uthorization for another 5- year period. The existing general permit authorizes the discharge of dredged or fill material for bridge maintenance in waters of the United States within the State of Missouri. This general permit was originally issued under the authority of Section 404 of the Clean Water Act (33 USC 1344) on March 31, 1983 and was last renewed on March 4, 2004. There have been 114 individual projects authorized by the general permit since it was last renewed.

SPECIAL PUBLIC NOTICE
SUMMARY:
On June 5, 2007, the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers announced agency guidance regarding Clean Water Act (CWA) jurisdiction following the U.S. Supreme Court’s decision in the consolidated cases Rapanos v. United States and Carabell v. United States ‘‘Rapanos’’). The agencies issued this guidance to ensure that jurisdictional determinations, administrative enforcement actions, and other relevant agency actions being conducted under CWA section 404 are consistent with the Rapanos decision and provide effective protection for public health and the environment. A six-month public comment period to solicit input on early experience with implementing the guidance began on
June 8, 2007. The agencies are extending the public comment period by 45 days.

Additionally, 0.42 acres of preserved upland buffer would be cleared and filled. The wetlands, stream, and upland buffer are part of an avoided and preserved wetland/buffer mitigation area that was deed restricted under a permit action issued in 2000. The proposed project will expand into a portion of this mitigation area. The proposed project will avoid 0.739 acres of forested wetland and 0.335 of upland buffer. A total of 4,000 cubic yards of fill will be required to expand the development. As migitation and compensation for the impacts, the applicant proposes to avoid, enhance, and preserve the remaining stream channel, wetland corridor, and upland buffer onsite. The remaining mitigation will be obtained by preserving higher quality wetlands within the White Oak Bayou Wetlands Mitigation Area. Sho Me Power Electric Cooperative has requested after-the-fact authorization for the placement of dredged and fill material in waters of the United States at four locations associated with the construction of a power transmission line and an attendant substation. Work at two of the locations resulted in wetland impacts totaling 9.86 acres during the clearing for and construction of the transmission line. These impacts are located in wetlands adjacent to Case Bolt Branch, in the NW 1/4 SE 1/4 of section 7, T. 23 N., R. 5 E, and in the NW 1/4 NE 1/4 of section 18. Also, to gain access to the transmission line right-of-way, a crossing was placed in an unnamed tributary to Case Bolt Branch, in the SW 1/4 NE 1/4 of section 18. The fourth location involved the relocation of an unnamed creek during construction of the 345/161/69kv substation south of Highway 160. The creek was originally 1275 feet in length (averaging 4.5 feet in width) and the new creek alignment is 1365 feet in length (averaging 11 feet in width). Approximately 700 feet of the new channel will be lined with stone. Chesapeake Operating, Incorporated has requested authorization for the placement of dredged and fill material in waters of the United States associated with the construction of an intake structure and boat ramp. The intake structure construction would require the installation of a sheet pile cofferdam. Approximately 435 cubic yards of compacted earth would be placed below the ordinary high water mark of the Little Red River inside the cofferdam to provide a seal. Approximately 120 cubic yards of concrete would be placed below the ordinary high water mark of the Little Red River for the construction of the intake structure and footings. A 48-inch-diameter screened ductile iron intake pipe would extend into the Little Red River for approximately 80 feet. Upon completion of the intake structure, approximately 680 cubic yards of fill would be placed below the ordinary high water mark of the Little Red River to fill the cofferdam, which would remain in place after construction is complete. An existing boat ramp would be rehabilitated with 4-foot by 8-foot precast concrete slabs. The proposed project is located on the right descending bank of the Little Red River, at mile 39.2, in the NE 1/4 of section 2, T. 8 N., R. 7 W., north of Searcy, in White County, Arkansas.
