Summary of the matter addressed in the submission:
Submitters allege that provisions of the "Emergency Supplemental Appropriations and Rescissions for the Department of Defense to Preserve and Enhance Military Readiness Act of 1995" ("Rescissions Act") have resulted in a failure to enforce effectively selected provisions of the Endangered Species Act. Specifically, submitters allege that the Rescissions Act prohibits the Fish and Wildlife Service from making "final determinations" for species or critical habitat designations for the remainder of Fiscal Year 1995. Submitters further allege that the Rescissions Act rescinds $1.5 million from the budget allocated to the listing program and prohibits the Fish and Wildlife Service from compensating for the loss from other programs.
