CEC receives submission on Minera San Xavier

 
Montreal, 7/02/2007 – On 5 February 2007, the Asociación Pro San Luis Ecológico (the “Submitter”) filed a citizen submission with the Secretariat of the Commission for Environmental Cooperation (CEC), asserting that Mexico is failing to effectively enforce its environmental laws with respect to the authorization of an open-pit mining project in the town of Cerro de San Pedro, San Luis Potosí.

In submission SEM-07-001 (Minera San Xavier), the Submitter asserts that in April 2006 the Secretariat of the Environment and Natural Resources (Secretaría de Medio Ambiente y Recursos Naturales—Semarnat) violated a Mexican court ruling by authorizing—for a second time— the gold and silver mining project by Minera San Xavier, the Mexican subsidiary of Canadian company Metallica Resources Inc. The Submitter asserts that in 2000 it successfully filed an appeal that led to a judicial decision canceling the original authorization and requiring Semarnat to consider guidelines established by the court. The Submitter asserts that Semarnat failed to comply with the court’s ruling in reauthorizing the project.

The Secretariat of the CEC will now analyze the submission to determine whether it meets the requirements of Article 14 of the North American Agreement on Environmental Cooperation (NAAEC).

The executive director of the Secretariat, Felipe Adrián Vázquez Gálvez, has recused himself from involvement in all matters relating to the Minera San Xavier submission.

The CEC citizen submission mechanism allows citizens to play an active "whistleblower" role in matters relating to environmental law enforcement. Pursuant to NAAEC Article 14, any citizen or nongovernmental organization may file a submission when it believes that a NAFTA partner is failing to effectively enforce its environmental law. After reviewing the submission, the CEC may investigate the matter and publish a factual record of its findings.
