Legal basis of Attorney General opinions

The Missouri Attorney General is authorized to issue formal opinions to certain government officials on questions of law that relate to their governmental duties. It is Section 27.040, Revised Statutes of Missouri, that both authorizes the Missouri Attorney General to issue those opinions and authorizes certain officials to request a formal opinion from the Attorney General.

The Missouri Attorney General is authorized to issue formal opinions to certain government officials on questions of law that relate to their governmental duties.

Among the officials authorized to request opinions are state legislators, statewide elected officials, state department heads and county prosecuting attorneys.

The Attorney General is not allowed to issue opinions to persons other than those specifically mentioned in Section 27.040, Revised Statutes of Missouri and is not allowed to issue opinions on questions that fall outside the scope of those persons official governmental duties.

To request an opinion on a question of law that relates to the discharge of official governmental duties, complete the form to request an Attorney General opinion. Once the form is completed, mail it to:

Missouri Attorney General opinions issued since 1969 are available online. You are encouraged to search for the opinion you are interested in, and if necessary, print the opinion using your browser menu.

Copies of opinions issued before January 1, 1969 may be obtained by following the instructions provided on this website.
