                        HOUSE OF REPRESENTATIVES

PROVIDING FOR CONSIDERATION OF THE CONFERENCE REPORT TO ACCOMPANY THE
BILL (H.R. 2419) TO PROVIDE FOR THE CONTINUATION OF AGRICULTURAL
PROGRAMS THROUGH FISCAL YEAR 2012, AND FOR OTHER PURPOSES

                                _______

May 13, 2008.--Referred to the House Calendar and ordered to be printed

                                _______

Mr. Cardoza, from the Committee on Rules, submitted the following

                              R E P O R T

                      [To accompany H. Res. 1189 ]

The Committee on Rules, having had under consideration
House Resolution 1189, by a record vote of 7 to 4, report the
same to the House with the recommendation that the resolution
be adopted.

SUMMARY OF PROVISIONS OF THE RESOLUTION

The resolution waives all points of order against the
conference report on H.R. 2419, the Farm, Nutrition, and
Bioenergy Act of 2007 and against its consideration. The rule
provides one hour of general debate equally divided and
controlled by the chairman and ranking minority member of the
Committee on Agriculture. The rule provides that the conference
report shall be considered as read. The rule provides one
motion to recommit.

                         EXPLANATION OF WAIVERS

The waiver of all points of order against the conference
report and against its consideration includes a waiver of
clause 8 of rule XXII (requiring a three-day layover of
conference reports and the accompanying joint explanatory
statement). Although the rule waives all points of order
against the conference report and against its consideration,
the conference report does not violate clause 9 of rule XXI. It
should be noted that the conference report uses the CBO 2007
baseline, the year in which the bill passed both the House and
the Senate, and under that baseline CBO has determined that the
conference report will not increase the deficit in either the
2008-2012 or the 2008-2017 scoring window. Therefore, while
there is a technical violation of clause 10 of rule XXI, the
conference report complies with the rule by remaining budget
neutral with no net increase in direct spending.
