Comment Submission Form
The Copyright Office is conducting a rulemaking proceeding mandated by the Digital Millennium Copyright Act, which provides that the Librarian of Congress may exempt certain classes of works from the prohibition against circumvention of technological measures that control access to copyrighted works. The purpose of this rulemaking proceeding is to determine whether there are particular classes of works as to which users are, or are likely to be, adversely affected in their ability to make noninfringing uses due to the prohibition on circumvention of measures that protect access.

Before considering submission of a comment, please read about the scope of this rulemaking.

As a part of the rulemaking, interested parties were invited to submit comments proposing classes of works for exemption in November 2008. These comments are available for viewing on our Proposed Classes page.

Persons now wishing to submit comments in support of or opposition to any of the proposed exemptions should use the form below.

Comment Period for Comments on Proposed Exemptions

The Copyright Office will be accepting comments on the proposed exemptions from January 2, 2009, until 5:00 P.M. EST on February 2, 2009. Persons who oppose or support any exemptions proposed in the initial comments now have the opportunity to comment on the proposed exemptions and to provide factual information and/or legal argument addressing whether a proposed exemption should be adopted. Since these comments are intended to be responsive to the initial comments, commenters must identify what proposed class they are responding to, whether in opposition, support, amplification or correction. Comments should first identify the proposed class, provide a summary of the argument, and then provide the factual and/or legal support for their argument. If a comment addresses more than one proposed classes, this format of class/summary/facts and/or legal argument should be repeated for each particular proposed class of work addressed.

The deadline for electronic submissions is 5:00 P.M. E.S.T Monday, Feb. 2. Commenters are strongly encouraged to submit comments well in advance of the deadline to allow sufficient time to correct any format defects and resubmit comments before the deadline.

Submissions must follow the format detailed in the notice of inquiry. Please review these requirements carefully to ensure your submission will be accepted.

Comment submission:
Preferred format: text saved as PDF (.pdf). Other permissible formats: Microsoft Word (.doc), WordPerfect (.wpd), Rich Text (.rtf) or ASCII text (.txt). Written comments must follow the format described in the Notice of Inquiry.

Before submitting your comment attachment, verify that your attachment:

  • Includes the commenter's name;

  • Includes an identification of the proposed class(es) to which the comment is responsive;

  • Numbers each proposed class(es) being addressed in the comment;

  • Provides a summary of the argument for each proposed class; and

  • Provides particular factual support or legal argument for each proposed class opposed or supported in the comment.
