Chairman Oberstar and Chairman DeFazio sent the attached letter to Secretary Peters late yesterday. It questions a DOT rulemaking that requires states to use a “fair market value” standard when dealing with toll operations on federally funded highways. The letter argues that using a market-based standard greatly favors private-sector operators over public toll authorities and ignores the public good in favor of a higher rate of return.
