Summary

This is our report on a major rule promulgated by the Environmental Protection Agency (EPA). It was published in the Federal Register as a final rule on October 27. The purpose is to reduce NOx and ozone transport across state boundaries in the eastern half of the United States. EPA finds that sources and emitting activities in each of the 23 jurisdictions emit NO x in amounts that significantly contribute to nonattainment of the 1-hour and 8-hour ozone national ambient air quality standards (NAAQS) or will interfere with maintenance of the 8-hour NAAQS in one or more downwind states. Enclosed is our assessment of the EPA's compliance with the procedural steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
