SYNOPSIS OF MARRIAGE REGULATIONS IN IDAHO
(Effective July 1, 1988 )

PERSONS WHO MAY MARRY

AGE PREREQUISITE REQUIREMENTS
MALES & FEMALES 18 Years of age or older. Unmarried and not otherwise of disqualified means. Proof of age upon request. No waiting period.
MALES & FEMALES 16 & 17 Years of age. Unmarried and not otherwise of disqualified means Proof of age. Consent of custodial parent or legal guardian by notarized statement. (see below) No waiting period.
MALES & FEMALES Under 16 Years of age. Unmarried and not otherwise of disqualified means. By order of Magistrate Court. Plus all requirements for 16 & 17 year olds. (Consent, proof of age, etc.) No waiting period

There is no residency requirement in the State of Idaho to obtain an Idaho Marriage License.

PROOF OF AGE REQUIREMENTS:

  • Driver's License or
  • State Id Card or
  • Birth Certificate

A SOCIAL SECURITY NUMBER IS REQUIRED BY EACH APPLICANT PER ID CODE.

If the person does not have a Social Security Number, they must provide us with a printout from a United States Social Security Office stating that they do not have a US Social Security Number, OR that they have applied for a US Social Security Number. Identification MUST be from the country where they are a citizen.

EXPLANATION OF PREMARITAL AIDS EDUCATION PAMPHLET:

Applicants are given a Premarital AIDS Education Pamphlet to read. After the pamphlet is read and understood, the applicants sign and date the certificate and this certificate is then attached to the marriage joint affidavit. The applicants keep the pamphlet.

EXPLANATION OF PARENTAL CONSENT:

Consent in writing, duly ACKNOWLEDGED and SWORN to before an OFFICER AUTHORIZED TO ADMINISTER OATHS, of the father, mother or guardian. When permission is given by a legal guardian, proof of said guardianship must be presented. (Deputies in the Recorder's Office and Notary Publics are authorized to administer oaths).

OFFICE HOURS:

The Recorder's office, where a marriage license is issued, is open from 9:00am to 5:00pm, Monday through Friday and Saturdays from 11:00am to 4:00pm, except holiday weekends.

SOLEMNIZATION OF MARRIAGES:

Licenses issued in Idaho must be solemnized in Idaho.

PERSONS WHO MAY NOT MARRY:

Marriages between parents and children, ancestors and descendents of every degree, and between brothers and sisters of the half as well as the whole blood, and between uncles and nieces, or aunts and nephews, are incestuous, and void from the beginning, whether the relationship is legitimate or illegitimate. All marriages between first cousins are prohibited.

MARRIAGE LICENSE FEE:

The fee for obtaining a marriage license is $28.00 during the week and $45.00 on Saturdays.

Certified copies of marriage licenses are available by mail request or you can come into our office during business hours. The fee is $2.00 for each certified copy. Requests per the Internet are not valid.
