Legislative Changes Affecting Dealers
This is a brief summary of some legislation enacted during the 2005 Legislative Session that will impact vehicle dealers from a DMV Business Regulation perspective.  If you have questions or need further information please contact Business Regulation at (503) 945-5281.

SB 997
This legislation amends ORS 802.033 to set the EVR fee at $25. This fee is in addition to the $50 Title and Registration Processing Fee which dealers may also charge. EVR dealers may charge a total of $75 between the two fees. Purchasers must still agree to pay the additional fee for the EVR service.
 
This law became effective on January 1, 2006.

SB 998
This legislation changes the weight restrictions for the issuance of passenger registration plates verses truck registration plates for large trucks and SUVs.
 
Vehicles with a loaded weight of 10,000 or less pounds may now have passenger registration plates.  Prior to this legislation any vehicle weighing more than 8,000 lbs when loaded was required to have truck registration plates to operate legally on Oregon roads.
 
This law became effective on January 1, 2006.

HB 2017
This legislation changed the lien perfection time limit from 20 days to 30 days to match the federal time limit.  ORS 803.100 and ORS 803.136 were amended to change Oregon law to mirror the new federal timeline.
 
This law became effective on October 17, 2005.

HB 2114
This legislation extends the number of days a DEQ certificate remains valid from 90 days to 180 days.
 
This law became effective on January 1, 2006.

HB 2422
This legislation extends the number of days a DEQ certificate remains valid from 90 days to 180 days.
 
This law became effective on January 1, 2006.

HB 2429
This legislation amends Oregon Revised Statutes to change the term “Wrecker” to “Dismantler” and, among other items:
  • Establishes a fee of $90 for “supplemental location dismantler certificates.”
  • Establishes the fee for replacing an existing dismantler certificate at $30.
  • Expands DMV’s authority to include the regulation of motor vehicle dismantling businesses and gives DMV the authority to impose civil penalties for specific violations of statutory requirements.
  • Dismantler certificate fees will be $450 and will now be valid for 3 years.
  • The bond required for both an original and for renewal of a dismantler certificate will be increased from $2,000 to $10,000.
Additionally, dismantlers will be restricted to selling vehicles to other dismantlers unless they also hold a vehicle dealers certificate.
 
This law became effective on January 1, 2006.

HB 2740
This legislation amended ORS 822.047 to distinguish a vehicle dealer from a vehicle broker.  The new law impacts how a vehicle broker receives payment for services and when a dealer with an inventory is acting as a vehicle broker rather than a vehicle dealer. The law requires disclosures to customers of the dealer’s status.
 
This law became effective on January 1, 2006.

HB 2825
This legislation amends ORS 803.530 to allow the transfer of specialty plates from one vehicle to another without converting the plate to custom registration, even though the specialty plate is no longer being issued.
 
Specialty plates, such as the Oregon Trail plate which is no longer issued, may now be transferred from a traded-in vehicle to a newly purchased vehicle without converting the plate to “custom registration” and paying the custom fee. 
 
This law became effective on January 1, 2006.

HB 3088
This legislation amends ORS 822.040 to allow the use of a valid dealer plate on a vehicle registered in a jurisdiction other than Oregon.
 
This law became effective on January 1, 2006.

HB 3089
This legislation amends ORS 822.040(4) creating an exception to the supplemental certificate requirements. Dealers displaying a vehicle off-site for advertising purposes are required to have a written agreement with the business where the vehicle will be displayed. The written agreement must be available for inspection by DMV investigators.
 
This law became effective on January 1, 2006.
