Electronic Submission



Electronic Submission:

You are now able to submit an electronic copy of your original filing with the Environmental Appeals Board (EAB). Parties submitting documents electronically will be excused from the requirement to submit multiple copies. Note: At the current time, any electronic submissions will not be considered a substitute for filing an original document with the Clerk of the Board. The Clerk of the Board must actually receive the original document in hard copy by the document’s due date in order for it to be filed timely. Until further notice, the electronic copy of a documents submitted through the Board’s electronic submission system will not be treated as a "filed" document. Electronic submission of the document copy also does not relieve you of the obligation to serve your filing on other parties.

At this time, a business confidentiality claim may not be asserted with respect to any information submitted through this electronic submission system. Any information for which a business confidentiality claim is asserted must be submitted in the manner specified in 40 C.F.R. §22.5(d).

How to Submit Documents:

The Environmental Protection Agency has created the Central Data Exchange (CDX), a single portal that allows users to register and then submit information electronically to a number of Agency programs. The EAB is using this portal with the expectation that at some time in the future you will be able to register and submit official filings electronically in lieu of paper filings.

All documents submitted electronically must be submitted in PDF format.

To submit documents electronically, follow these steps:
  • Register with EAB through CDX (If you are a first time electronic submitter)
  • Login to the CDX site and select the profile "EAB: Environmental Appeals Board" (If you are already registered, go directly to login here)
  • Read the instructions and complete the submission form,
    - Browse and attach your file
    - Enter a descriptive Subject
    - Enter your contact information and any other comments you might have about your submission. Then,
  • Click "Send" to upload your file.
