64 Employment of Workers with Disabilities at Special Minimum Wages
under Section 14(c)
Section 64h Concluding Activities
- Work center investigations and investigations of the employment of workers with disabilities in competitive employment under section 14(c) should be registered in WHISARD as "SMW14" cases. Patient worker investigations should be registered as "SMWPW."
- See the FOH for specific instructions for reporting the findings of work center and patient worker investigations. The INV should ensure that SMW back wages due a worker with a disability under the SCA and Section 14(c) of the FLSA are properly recorded in WHISARD.
- WHISARD uses the North American Industry Classification System (NAIC) rather than Standard Industrial Codes (SIC). Some of the more common NAICs are:
- Private work centers:
- NAIC 62431 (private vocational rehabilitation services)
- State operated work centers:
- Local government operated work centers:
Note: the NAIC "selection tree" picks only government-operated facilities when the word "sheltered" is entered.
