(Effective November 26, 2007) The new procedures for rulemaking (Section VII.) are not water quality standards and EPA thus takes no action on them under CWA §303(c). In addition, EPA has not taken action on the new narrative and numeric provisions requiring maintenance of minimum stream flow (Section III. Part Q and Section IV. Parts 2 A, B, C and G). EPA will fully evaluate these provisions upon submittal of additional information on implementation.

(Effective April 7, 2006) EPA has not completed its review of the revised criterion for mercury adopted under the Livestock and Wildlife use in Section IV.F. of the 2002 water quality standards. The revised mercury criterion has not been approved under section 303(c) of the Clean Water Act and the implementing federal regulations. The mercury criterion in Section IV. E. Livestock an Wildlife of the 1995 water quality standards is effective for Clean Water Act purposes.

Pueblo of Taos

(Effective June 19, 2006) EPA has not completed its review of the criteria for DDT and polychlorinated biphenyls in Appendix C and the mercury criteria in Appendix C, Appendix D, Appendix E and Appendix F. These criteria have not been approved under section 303(c) of the Clean Water Act and the implementing federal regulations.

Confederated Salish and Kootenai Tribes of the Flathead Indian Reservation

(Effective April 11, 2007) The Tribes' water quality standards are applicable to "waters of the Tribe". In some limited instances, the definition adopted by the Confederated Salish and Kootenai Tribes for "waters of the Tribe" as part of its water quality standards may result in water quality standards that are more comprehensive than required under section 303(c) of the Clean Water Act and the implementing federal regulations. EPA has included the Confederated Salish and Kootenai Tribes' water quality standards in their entirety here for context and as supplementary information for the reader.
Assiniboine and Sioux Tribes of the Fort Peck Indian Reservation
