TWO MIAMI-DADE POLICE OFFICERS INDICTED FOR TAX EVASION CHARGES

Marcos Daniel Jiménez, United States Attorney for the Southern District of Florida; Lorraine Johnson, Acting Special Agent in Charge, Internal Revenue Service, Criminal Investigation; and Carlos Alvarez, Director, Miami-Dade Police Department, announced today the arrest and Indictment of two Miami-Dade Police Department police officers, William Bernard Oertwig, Jr. and Ronald Edward Young, on tax evasion charges.

The Indictment charges Oertwig with six counts of Attempting to Evade and Defeat Tax, in violation of 26 United States Code, Section 7201, for failing to claim any taxable income from 1996 through 2001. A separate Indictment charges Young with five counts of Attempting to Evade and Defeat Tax, in violation of 26 United States Code, Section 7201, for failing to claim any taxable income from 1997 through 2001.

Both defendants filed false W-4 forms with the Miami-Dade Police Department each of the relevant years, stating that they were exempt from any withholding. Thereafter, both defendants filed false returns with the Internal Revenue Service for those four years. In addition, the Indictment also alleges that Oertwig failed to file a tax return for an additional two years, and that Young failed to file a tax return for one year.

Oertwig and Young face a maximum penalty of five years’ imprisonment on each count, and a $100,000 fine.

Mr. Jiménez commended the investigative efforts of the Miami-Dade Police Department, and the Internal Revenue Service, Criminal Investigation. The case is being prosecuted by Assistant United States Attorney Anita J. Gay.
