SENTENCING IN FRAUDULENT TAX REFUND CONSPIRACY

Marcos Daniel Jiménez, United States Attorney for the Southern District of Florida, and Jose I. Marrero, Special Agent in Charge of the Miami Field Office, Internal Revenue Service, Criminal Investigation, announced today the sentencing of the last defendant in a six-defendant tax fraud conspiracy. The defendants, Feliciano Aguayo, Maria Sosa, Lorenza Sosa, Elizabeth Sosa Feliciano, Jose Torres, and Aurelia Urrea previously pled guilty to conspiring to file false tax returns claiming fraudulent refunds, in violation of Title 18, United States Code, Section 286.

United States District Court Judge Joan A. Lenard sentenced Feliciano Aguayo, Maria Sosa, Lorenza Sosa, Elizabeth Sosa Feliciano, and Jose Torres to one year and a day of incarceration. Aurelia Urrea was sentenced today to four months’ imprisonment, to be followed by four months of home confinement. All defendants were ordered to jointly pay $285,345 in restitution.

As set forth in the Indictment, the conspiracy extended from January 1994 to December 1998. The defendants caused the filing of multiple tax returns containing fabricated W-2s for themselves and for other individuals from the Homestead metropolitan area. The refunds ranged from approximately $2,000 to $4,000 each. In their plea agreements, the defendants admitted the conspiracy involved $285,345 in fraudulent refund claims.

Mr. Jiménez commended the investigative efforts of the Internal Revenue Service, Criminal Investigation. The case was prosecuted by Assistant United States Attorney Ana Maria Martinez.
