Title INarcotic Rehabilitation Act

Under Title I of the Narcotic Rehabilitation Act (28 U.S.C.
§§
2901
to 2906), certain narcotic addicts charged with a Federal offense may be
eligible
for civil commitment in lieu of criminal prosecution. An individual may
submit
to an initial exam to determine if he/she is an addict who is likely to be
rehabilitated through treatment. If the court finds such an addict is a
proper
subject for rehabilitation, he or she will be committed to the custody of
the
Surgeon General for a period not to exceed 36 months. The pending criminal
charge is held in abeyance if the patient is unsuccessful in the
rehabilitation
program. However, prosecution is resumed if the patient is unsuccessful in
the
rehabilitation program.
