JURY FINDS FORMER FBI AGENT GUILTY OF ASSAULTING DEPUTY U.S. MARSHAL

Kevin J. O’Connor, United States Attorney for the District of Connecticut, today announced that a federal jury in Bridgeport has found GARY L. JOHN, age 58, formerly of 110 Post Road, Westerly, Rhode Island, guilty of felony assault on a federal officer. The trial began on Tuesday, January 16, and the jury returned its verdict yesterday, January 18, after deliberating for approximately three hours. JOHN is a retired special agent with the Federal Bureau of Investigation.

According to the evidence presented during the trial, on December 8, 2005, Deputy United States Marshals were attempting to locate JOHN, who was a fugitive arising out of state warrants issued in Rhode Island for violation of protective and no contact orders, and for failure to appear. When a Deputy U.S. Marshal attempted to arrest JOHN in Stratford, Connecticut, JOHN struck the Deputy Marshal with his fist. After a struggle, the law enforcement officers were able to place JOHN under arrest. JOHN has remained in custody since his arrest.

“We are pleased with the jury’s verdict,” U.S. Attorney O’Connor stated. “This Office will not tolerate assaults on federal officers who are in the process of enforcing the law, and individuals who engage in such conduct, especially those who are or at one time were members of law enforcement themselves, will be prosecuted to the fullest extent.”

JOHN is scheduled to be sentenced by United States District Judge Janet C. Hall on April 10, 2007, at which time JOHN faces a maximum term of imprisonment of eight years and a fine of up to $250,000.

This case was investigated by the United States Marshals Service, the Rhode Island Sheriff’s Department and the Stratford Police Department. The case is being prosecuted by Assistant United States Attorney Anthony E. Kaplan.
