FAQ-121: Counting Operator Employees when Identifying HCAs

Question: Must facilities occupied by an operator's employees be considered in identifying HCAs?

Answer: Yes. The rule is intended to provide enhanced protection for gatherings of people, and gatherings of operator employees are expected to gain the same enhanced protection. Areas, including buildings and facilities, where operator employees gather in sufficient numbers and on a sufficient number of days to meet criteria in the definition of HCAs should be so classified.
