GSA plans, directs and coordinates all aspects of contractor integrity program including suspension or debarment of contractors or participants in non-procurement programs, agency level protests, acts as agency ombudsman, and represents the Administrator of GSA on the Federal Prison Industries’ (FPI) Arbitration Board.

GSA has agency-wide responsibility for the suspension and debarment of contractors under the Federal Acquisition Regulation (FAR) and participants in non-procurement programs under the Non-procurement Common Rule. Develops plans, establishes goals and objectives to ensure that GSA’s procurement program operates effectively and efficiently. Proposes and, in conjunction with the Office of the General Counsel and other relevant executive agencies, develops recommendations for regulatory or legislative changes to promote procurement integrity. Provides guidance and advice to the Office of Inspector General and contracting activities on matters related to contractor integrity.  Conducts hearings and issues written decisions. Negotiates settlement agreements in lieu of suspension or debarment when appropriate to protect the government’s interest.  Oversees the publication of the Governmentwide List of Parties Excluded from Federal Procurement and Non-procurement Programs. Provides advice and guidance related to suspension and debarment to other government agencies, states and local governments, and the private sector.

Provides an independent review of contractor protests. Reviews disputed solicitation provisions and the application of procurement regulations to ensure that procurement actions conform to case law, Government Accountability Office (GAO) decisions and precedents. Conducts hearings when necessary or requested by the parties to the protest and issues written decisions. Suggests and develops changes to agency and governmentwide procurement regulations and policies.

Reviews contractor complaints to ensure that all contractors are treated fairly and afforded a fair opportunity to be considered for task and delivery orders when multiple task and delivery contracts are awarded. Reviews the solicitation, and the contracting officer’s determination and evaluation to ensure compliance with procurement regulations, agency policies and case law. Suggests and develops changes to agency regulations to ensure contractors are treated fairly and encourage competition.

Along with a representative of the Department of Justice and the President, resolves disputes as to the rice, quality, character, or suitability of products marketed by FPI.  Participates in the drafting and issuance of final Board decisions. Ensures that disputes involving FPI and other government agencies are resolved in accord with law and regulations.

Promotes competitive procurements and challenges noncompetitive procurements.  Coordinates activities of competition advocates for GSA contracting activities.
