U.S. Labor Department Recovers Over $6,000 in Back Wages for 28 Huntersville, N.C., Bakery Workers

CHARLOTTE, N.C. -- Just Fresh Bakery Cafe has agreed to pay $6,256 in overtime back wages to 28 employees at the company’s Huntersville store after the U.S. Labor Department’s Wage and Hour Division determined the company violated the Fair Labor Standards Act (FLSA).

“The Department of Labor is committed to ensuring that low-wage workers receive the wages they have earned,” said John Blaine, director of the Wage and Hour district office in Charlotte.

An investigation by the department’s Wage and Hour Division determined that between June 2003 and June 2005, the company failed to pay employees overtime when they worked more than 40 hours in a workweek.

Investigators found that employees were required to work through their lunch breaks, but that time was not included in computing total number of hours worked. The company also allegedly failed to combine all hours of work when employees worked at different locations during a workweek.

The bakery owner cooperated with Wage and Hour investigators and agreed to future compliance with the FLSA.

The FLSA requires that employers pay covered non-exempt workers one-and-one half times their regular rate of pay for all hours worked over 40 in a single workweek. Employers must also maintain accurate records of employees’ wages, hours and other conditions of employment.
