U.S. Labor Department Recovers Over $100,000 for 35 Burton, Ohio, Area WorkersCLEVELAND -- “The Labor Department is committed to ensuring that low-wage, non-exempt employees are paid at an overtime rate when they work more than 40 hours in a work week,” said George Victory, acting district director for the Wage and Hour Cleveland office. The Wage and Hour investigation determined that between November 2003 and November 2005, the company failed to pay for travel time for field employees. Time spent by an employee in travel as part of his or her principal activity, such as travel from job site to job site during the workday, is work time and must be counted as hours worked. Once notified of the violations, the company cooperated fully with investigators and agreed to comply with the Fair Labor Standards Act in the future. The overtime provisions of the FLSA require employers to pay covered, non-exempt workers one-and-one-half times their regular rate of pay for all hours worked over 40 in a single work week and to maintain accurate employment records.
