Congress recently passed the FY 2004 Omnibus Appropriation Act, and we anticipate that the President will sign it soon. In the conference report (H. Report 108-401) accompanying the Act, Congress has designated Discretionary Bridge Program funding for specific projects. In addition, Section 547 of the Transportation, Treasury, and Independent Agencies Appropriations Act (Division F of the Omnibus Act) declares these projects to be eligible for Bridge Discretionary Program funding "notwithstanding any other provision of law."

Since a bill providing full FY 2004 funding authorizations for the various highway programs has not been enacted, all FHWA program funding is uncertain at this time. The Surface Transportation Extension Act of 2003 (Public Law 108-88), provided new FY 2004 contract authority through February 29 at 5/12 the amount authorized in FY 2003. The multiyear authorization bill now being considered by both the House and the Senate may or may not include funding for the Discretionary Bridge Program; therefore, final FY 2004 funding levels are uncertain.

In order to be prepared when the FY 2004 authorization amounts are known, we request that you submit project proposals for which funding has been designated in the FY 2004 Omnibus Appropriation Act, based on the amounts earmarked. Projects and amounts earmarked are included in this memo and as Attachment 1 for your convenience.

To help us in preparing Congressional notification reports please provide a completed discretionary bridge program application, included in this memo and separately as Attachment 2 for your convenience. Project application submissions must be received in Headquarters no later than February 27, 2004. When submitting the State's project applications, we are requesting that you, the division office, transmit the completed applications via email to Edgar Small (edgar.small@fhwa.dot.gov, (202) 366-4622) of my staff.

Only those States with projects designated in the conference report and listed in Attachment 1 need to respond to this solicitation. Please do not submit any applications for projects that are not listed in Attachment 1. Please recognize that the full amount of this funding may not be available. We will provide further information on the amounts to be provided for each designated project as it becomes available.
