INDICTMENT
The Grand Jury charges:
COUNT ONE: Title 29, United States Code, Section 501(c) (Union Embezzlement) and Title 18, United States Code, Section 2 Aiding and Abetting)
- At all times material to this Indictment, Boilermakers AFL-CIO, Local Lodge 1851 (“Local 1851”), Chicopee, Massachusetts, was a labor organization in an industry affecting commerce within the meaning of Sections 402(i) and 402(j) of Title 29, United States Code.
- At all times material to this Indictment, GENE MALINOWSKI was an officer, that is, the Business Agent and Secretary/Treasurer of Local 1851.
- On or about and between January, 2000, and November,
2001, in Chicopee, in the District of Massachusetts,

the defendant herein, did embezzle, steal and unlawfully and willfully abstract and convert to his own use and the use of another the moneys, funds, securities, property and other assets of Local 1851.
All in violation of Title 29, United States Code, Section 501(c) and Title 18, United States Code, Section 2.
