National Information: Stormwater Discharge From Industrial Facilities

EPA Releases the MSGP-2008

EPA has recently announced the availability of the final Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activities (MSGP -2008). The text of the final permit is now available on EPA's website, www.epa.gov/npdes/msgp; EPA's official announcement of the MSGP will be published in the Federal Register later this month.

IMPORTANT NOTE: The MSGP-2008 is not yet issued for industrial facilities located in Alaska and Idaho; for Federal Facilities in Washington State; or for facilities located within Indian Country located in ID, WA and OR.

Why? Now that the final text of the MSGP-2008 is available, EPA Region 10 must request final certification of the MSGP from each state and certain tribal governments in accordance with Clean Water Act Section 401. Final certification of the MSGP may result in additional state- or tribal-specific permit requirements for facilities located in these areas. Any additional permit conditions will be included in Part 9 of the MSGP.

EPA expects to complete the Sec. 401 certification process and issue the MSGP for these areas by the end of the 2008 calendar year. Existing MSGP permit coverage for facilities in AK, ID, WA and Indian Country will be administratively continued until EPA completes this Sec. 401 certification process.

What should facility operators do in the interim? Facility operators needing permit coverage under the MSGP in the Pacific Northwest and Alaska should do the following:

1) Read the MSGP -2008 permit text, and implement actions as required, and
2) Update their facility's Storm Water Pollution Prevention Plan as necessary.
3) When EPA issues the MSGP-2008 for AK, ID, Federal Facilities in WA and Indian Country in WA, OR and ID, operators should then review and comply with any relevant state- or tribal-specific requirements. Operators may then submit a Notice of Intent to EPA for coverage under the MSGP-2008.
