Filing a Lawsuit
Where a lawsuit is filed in the courts to resolve the alleged violation of the Act, there is no requirement that the Secretary of
Labor be notified before the filing of such a lawsuit. In addition to a judgment an employee may recover from the employer:
- Reasonable attorney’s fees
- Reasonable expert witness fees
- Other costs of the action
