Filing a Lawsuit

Where a lawsuit is filed in the courts to resolve the alleged violation of the Act, there is no requirement that the Secretary of Labor be notified before the filing of such a lawsuit. In addition to a judgment an employee may recover from the employer:

  • Reasonable attorney’s fees
  • Reasonable expert witness fees
  • Other costs of the action
