For the provisions of FLSA Section 14(c) to apply, the worker must be covered by (subject to) the provisions of the FLSA or some other Federal labor standards statute. Therefore, you should determine whether your business is covered under any of the following:

• Fair Labor Standards Act (FLSA)
• McNamara-O’Hara Service Contract Act (SCA)
• Walsh-Healey Public Contracts Act (PCA)
• Davis-Bacon and Related Acts (DBRA)
• Contract Work Hours and Safety Standards Act (CWHSSA)
• Family and Medical Leave Act (FMLA)
