SUBJECT: DAVIS-BACON AND RELATED ACTS:
REQUEST FOR DETERMINATION AND RESPONSE
TO REQUEST, STANDARD FORM 308
(REPLACES FORMS DB-11 and DB-11a)
Attached is a copy of the new Standard Form 308 which, as soon as
the Agency can obtain a supply, should be used in requesting project
wage determinations for construction subject to the Davis-Bacon Act
as Amended and Related Statutes. Project wage determinations are
requested when there is no applicable area determination or when there
is a question as to the applicability of an area wage determination.
Area determinations are published in the Federal Register and may be
used where applicable without specific authorization by the Department
of Labor. If the contracting officer has some question as to whether
a published area decision properly applies to a project, a Standard
Form 308 should be submitted specifically referring to the area decision
and pointing out the reasons its applicability is questioned. The
stock number for Standard Form 308 is 75401050078. The cost is 35¢
per 100 copies. They are now available through regular Federal supply
channels.
In its basics SF-308 is not different from forms DB-11 and DB-11a.
New features include provisions for the Agency telephone number and
the address to which the determination should be mailed. The request
will become the face of the determination which will be mailed to the
Agency in a window envelope.
Requests should continue to be submitted to the appropriate Regional
Office of the Employment Standards Administration. See Memorandum #105.
Please submit requests ' duplicate. Questions concerning the form may
be directed either to the Region or to the Washington Office.
