Federal Register: August 26, 2008 - The Department of Transportation is changing the effective date of 49 CFR 40.67(b) from August 25, 2008, to November 1, 2008. The Department is also requesting comments concerning the content of §40.67(b) for 30 days.


49 CFR Part 40 has recently been updated.  Read the revisions in the Federal Register.  FTA has also published an updated Urine Specimen Collection Guidelines that adheres to the revised regulations (effective August 25, 2008).  A summary of the changes found within the updated guidelines is located here.



The Best Practices Manual: Example Drug and Alcohol Policies and Procedures contains drug and alcohol policies and procedures that are intended to update the original example polices that were first published with the Best Practices Manual: FTA Drug and Alcohol Testing Program in March 2002. These example policies have been reviewed and determined to be current and fully-compliant with the revised 49 CFR Parts 40 and 655.  The document also contains three template policies that may be adjusted or tailored according to the needs of any employer.


The Administrator has determined that the random drug testing rate shall remain at 25% for 2008. In 2006, the FTA retained the random alcohol testing rate of 10 percent (reduced previously from 25 percent).
