WHD Press Release: Red Wings Auto Repair Inc., Glen Ellyn, Ill., Pays $35,000 For Alleged Federal Wage-Hour Violations

Firm permanently enjoined from future violations

Chicago, IL — Red Wings Auto Repair, doing business as Mobil at 22 W. 070 Butterfield Rd., Glen Ellyn, Ill., has paid $35,000 for overtime pay violations found by the U.S. Department of Labor.

The firm was ordered by U.S. Magistrate Judge Nan R. Nolan, U.S. District Court, Northern District of Illinois, Eastern Division, to pay $30,000 in back wages and $5,000 in liquidated damages to five present or former workers. The court permanently enjoined the company and Husam Tillawi from future overtime pay and record keeping violations of the Fair Labor Standards Act, the federal wage and hour law. The violations occurred during August 1996 to December 1999.

Wage and Hour Division District Director Dennis McInerney in Chicago said, "This case exemplifies the Labor Department's efforts to protect vulnerable low wage workers and prevent future violations."

Red Wings Auto Repair Inc. is a retail gasoline station. The firm repairs autos and sells cigarettes and food.

The Labor Department's Wage and Hour Division enforces the Fair Labor Standards Act (FLSA) which sets a federal minimum wage of $5.15 for most workers. The law generally requires overtime pay for hours worked over 40 in a workweek. The FLSA requires employers to keep accurate time and payroll records.

The legal action followed an investigation by the Wage and Hour District Office, 230 S. Dearborn, Chicago, Ill.
