Bergan Mercy Health System Pays Penalty for Alleged Overtime Violations

KANSAS CITYBergan Mercy Health System, Omaha, NE, paid $7,500 in civil money penalties for alleged violations of the overtime provisions of the Fair Labor Standards Act (FLSA) of 1938, as amended, the U.S. Department of Labor's Wage and Hour Division announced today.

Gary D. Volok, Wage and Hour district director in Omaha, said an investigation which covered the period March 1993 through March 1996 disclosed a total of $7,436 in overtime back wages was due 17 employees. The alleged repeated and willful violations involved nurses who were paid on a piece rate basis and, some employees misclassified as administrative were not paid any additional overtime hours worked in excess of 40 hours per week.

A previous investigation of the firm involved similar alleged overtime violations involving nurses doing piece rate work. The investigative period covered 1989 to 1990 and approximately 350 to 400 employees were found due $135,000 in unpaid overtime compensation.

The Wage and Hour Division enforces the laws and regulations of the Fair Labor Standards Act of 1938, as amended, which includes not only overtime pay, but the minimum wage, recordkeeping and child labor provisions. The Act requires covered employers to pay overtime for hours worked in excess of 40 hours in any workweek, to pay the minimum wage (currently $4.25 per hour), and to keep adequate time and payroll records. It also protects against child labor abuse. The federal wage and hour law covers more than 90 million workers nationwide.
