Pioneer Health Center Pays Back Wages for Overtime Violations $L5,600 in Penalties Assessed

Americare Systems Inc., doing business as Pioneer Health Center in Marceline, Mo. paid $19,976 in back wages and was assessed $15,600 in civil money penalties (CMPS) for violations of the overtime provisions of the Fair Labor Standards Act (FLSA) of 1938, as amended, the U.S. Department of Labor announced today.

Based upon an investigation conducted by the Department's Wage and Hour Division, the firm failed to pay overtime to 78 employees. Terry L. Burger, district director in Kansas City, said the investigative period covered March 1992 through March 1994 and the CMPs were assessed for repeat violations by the employer.

According to Burger, two previous investigations of Americare Systems, Inc. facilities included $1,280 in back wages paid to seven employees of Galena Manor Nursing Home in Galena, Ks. and $5,255 in back wages paid to 27 employees of Southridge Nursing Facility in Louisburg, Ks. This facility also was assessed and paid $1,147 in CMPS.

The FLSA requires covered employers to pay employees time and one-half their regular rate for all hours worked in excess of 40 hours in a work week.

The Wage and Hour Division enforces the laws and regulations of the FLSA which also includes the minimum wage (currently $4.25 per hour) and provides protection against child labor violations. The federal wage and hour laws cover more than 90 million workers nationwide.
