White's Foodliner IGA Pays $13,071 in Penalties for Alleged Child Labor Violations

White's Cimlodgco Inc., Cimarron and Medicine Lodge, KS doing business as White's Foodliner IGA paid $13,071 in penalties for alleged child labor violations of the Fair Labor Standards Act (FLSA) of 1938, as amended, the U.S Department of Labor's Wage and Hour Division announced today. The alleged violations involved 21 minors.

Gary D. Volok Wage and Hour district director in Omaha, Nebraska said that the firm in Cimarron allegedly violated the hours and time provisions of the law by illegally employing fourteen 15 year old minors, and worked as late as 9:30 p.m.,as many as six hours on school days and as many as 35 hours during school weeks; worked as many as 11 hours on nonschool days and as late as 9:30 p.m. during nonschool weeks. One 16 year old minor was employed in violation, occupation of motor-vehicle driver to make deliveries and run errands.

Also in Medicine Lodge five 14/15 year old minors illegally employed; worked as late as 9pm, as many as 5 hours on school days and as many as 28 hours during school weeks; worked as many as 10 hours on nonschool days. One 15 year old minor was employed in violation, occupation of motor-vehicle driver to make deliveries and run errands, and another 16 year old minor was employed in violation of occupation of involving the operation of power-driven meat slicing machine.

The child labor regulations for 14 and 15 year-olds prohibit employment before 7:00 a.m. or after 7:00 p.m (after 9:00 p.m. June 1 through Labor Day). Minors may not be employed more than three hours a day on school days and no more than 18 hours a week during school weeks. During non-school weeks, 14 and 15 year-olds may not work more than eight-hours a day or more than 40-hours per week. The law also restricts employment in specific hazardous occupation for all youngsters under 18. Different standards apply to farm labor.
