Country Kitchen Restaurants in Nebraska Cited for Alleged Child Labor Violations

Country Kitchen restaurants in Kearney, Grand Island and Ogallala, Ne. were cited by the U.S. Department of Labor's Wage and Hour Division for alleged child labor violations and assessed $7,900 in civil money penalties (CMPs), Gary D. Volok, Wage and Hour district director in Omaha announced today. A total of 19 minors was involved.

The firms were cited for working minors under 16 years old past midnight, more than 10 hours per day and some minors worked more than 18 hours per week while school was in session. Volok indicated that scheduling and working minors under 16 in this manner was in violation of the child labor provisions of the Fair Labor Standards Act (FLSA) of 1938, as amended.

Child labor regulations control the hours during which children under 16 may work, and restrict employment in specific hazardous occupations for all youngsters under 18. Generally, youths under 14 may work only in a few specified jobs that are exempt (for instance, newspaper delivery) from the general prohibition in the law, or in employment not covered by the law. Different standards apply to farm labor.

The firms have paid the full amount of the CMPs assessed.
