U.S. Labor Department Refers Cody Zeigler, Inc. Wage Dispute to Administrative Law Judge for Final Determination
WASHINGTON The U.S. Labor Department’s Wage and Hour Division has asked an Administrative Law Judge to rule on its claim that Cody Zeigler, Inc., a building contractor located in Summit Station, Ohio, failed to pay workers appropriate overtime pay, prevailing wages and fringe benefits as required under federal law.
The Labor Department has alleged that the firm failed to pay laborers and mechanics working on the construction of a new post office in Dublin, Ohio and on a postal facility in Westerville, Ohio, prevailing wage rates and fringe benefits as required by the federal Davis-Bacon Act and the Contract Work Hours and Safety Standards Act. Cody Zeigler, Inc. worked on the two Postal facilities in 1995.
The Labor Department’s Wage and Hour Division enforces the provisions of the Davis-Bacon and related acts. These acts require contractors and subcontractors to pay prevailing wages and benefits to workers engaged in federal construction, alteration or repair of public buildings or works.
Overtime pay on federal projects is required by the Contract Work Hours and Safety Act. Employers must pay workers one and one-half times the basic rate of pay for all hours worked over 40 in a week.
Legal actions follow an investigation made by the Wage and Hour District Office, 200 N. High St., Columbus, Ohio under the supervision of District Director Richard J. Malloy.
