Werner Lembke, Formerly Doing Business as Lembke Trucking, St. Paul Park, Minn., Agrees to Pay Back Wages of $41,774 and Ordered Debarred From Federal Contracts for Three Years

WASHINGTON — Werner Lembke, formerly doing business as Lembke Trucking, 720 S. Fourth Street, St. Paul Park, Minn., was ordered to pay back wages of $41,774.84 to six employees and will be debarred from federal contracts for three years after violations were found by the U.S. Department of Labor.

The trucking company agreed to entry of consent findings issued by Administrative Law Judge Paul Teitler of the Labor Department’s Office of Administrative Law Judges in Camden, N.J., under the McNamara-O’Hara Service Contract Act. A complaint filed by the Labor Department alleged that the firm failed to pay prevailing wages and fringe benefits to employees who worked on two mail hauling contracts. The investigation covered the period July 1993 to August 1995.

Werner Lembke, sole owner of Lembke Trucking will be placed on the Comptroller General’s ineligible list and will not be awarded any contract with the United States for a three-year period.

Wage and Hour District Director Denise Scharlemann in Minneapolis said, "This case exemplifies the Labor Department's efforts to protect employees who work on government contracts and ensure that contractors fulfill their legal obligations."

The McNamara-O'Hara Service Contract Act of 1965 (SCA) requires wage and fringe benefit payments to employees who work under government contracts of $2,500 or more. Contractors and subcontractors must pay the prevailing wages and fringe benefits established by the Labor Department's Wage and Hour Division.

The legal action resulted from an investigation by the Wage and Hour District Office, 220 South Second Street, Minneapolis, Minn., under the supervision of Denise Scharlemann, district director.
