Elaine's Cleaning Service Inc., Dayton, Ohio, Pays $65,000 to 145 Employees to Resolve Charges of Alleged Federal Contract Violations

WASHINGTON — The U.S. Department of Labor announced today that Elaine's Cleaning Service Inc., 4108 Dayton-Xenia Road, Dayton, Ohio, has paid $65,000 to 145 employees to resolve charges of alleged federal contract violations.

Administrative Law Judge Robert L. Hillyard of the Labor Department’s Office of Administrative Law Judges in Cincinnati, Ohio, approved the settlement under the McNamara-O’Hara Service Contract Act (SCA). A complaint by the Labor Department alleged that the firm failed to pay prevailing wages and fringe benefits to employees from January 1993 to December 1994. The complaint also alleged that the company failed to maintain adequate records of hours worked by employees. Elaine's Cleaning Service Inc. did not admit liability for the alleged violations.

Wage and Hour District Director Richard Malloy in Columbus said, "This case exemplifies the Labor Department's efforts to protect employees who work on government contracts and ensure that contractors fulfill their legal obligations."

Elaine's Cleaning Service Inc. provided janitorial and maintenance services at Wright-Patterson Air Force Base.

The McNamara-O'Hara Service Contract Act of 1965 (SCA) requires wage and fringe benefit payments to employees who work under government contracts of $2,500 or more. Contractors and subcontractors must pay the prevailing wages and fringe benefits established by the Labor Department's Wage and Hour Division. Firms that violate the SCA may be debarred from work on any government contract for three years.

The legal action resulted from an investigation by the Wage and Hour District Office, 200 North High Street, Columbus, Ohio, under the supervision of Richard Malloy, district director.
