Speed Lube LLC, Highland, Ill., Assessed Civil Money Penalty Of $16,400 for Alleged Repeat Overtime Violations
82 Assistant Managers paid $32,221 in back wages
WASHINGTON The U.S. Department of Labor has assessed a civil money penalty of $16,400 to an operator of 37 auto oil change stores in the Midwest for alleged repeat overtime pay violations.
An investigation by the Labor Department under the Fair Labor Standards Act found that Speed Lube LLC, based in Highland, Ill., did not pay assistant managers overtime pay after 40 hours in a week. The 82 assistant managers were paid $32,221 in overtime back wages because they did not supervise two full-time workers or did not have management as their primary duty. The violations occurred from October 1996 to October 1998.
Henry Rodriguez, district director of the Labor Department's Wage and Hour Division in Springfield, Ill., said, "This case exemplifies the Labor Department's efforts to ensure that workers are paid properly for overtime hours. Civil money penalties send a clear message to employers."
Speed Lube LLC is headquartered at 2650 Plaza Dr., Highland, Ill. The company operates oil change establishments for vehicles in Illinois, Indiana, Iowa, Missouri, Tennessee, and Kentucky. The Wage and Hour Division found violations at:
- Mt. Vernon, Jacksonville, Pekin, Highland, Taylorville, Morton, East Peoria,, Troy, Galesburg, Mattoon, Charleston, Rantoul, Canton, Macomb, West Frankfort, Chatham, Peoria, Normal, Champaign, and Danville, Ill.; - Evansville, Ind.; - Clinton, Newton, Marion, Bettendorf, Burlington, Davenport, Muscatine, and Ft. Madison, Iowa; - Rolla, Mo.; - Dyersburg, Dickson, and Clarksville, Tenn.; and - Bardstown, Ky.
The Labor Department also found record keeping violations at the firm. Speed Lube LLC failed to record the daily and weekly hours worked by the assistant managers.
The Wage and Hour Division found prior overtime violations at Speed Lube LLC during investigations in 1996 and 1997.
The firm has appealed the civil money penalty. The employer will be given the opportunity to discuss the alleged violations with the Wage and Hour Division. Civil money penalties that are not resolved by the Wage and Hour Division are referred for a hearing by a Labor Department administrative law judge.
The Labor Department's Wage and Hour Division enforces the Fair Labor Standards Act which sets a federal minimum wage of $5.15 for most workers. The federal law generally requires overtime pay for hours worked over 40 in a workweek. Employers are required to keep accurate time and payroll records.
The investigation was conducted by the Wage and Hour District Office, 509 West Capitol Avenue, Springfield, Ill., under the supervision of Henry Rodriguez, district director.
