U.S. LABOR DEPARTMENT FILES COMPLAINT AGAINST PREMIERE PUBLICATIONS INC., MIDDLETOWN, OHIO, ALLEGING FEDERAL WAGE-HOUR VIOLATIONS

Chicago — The U.S. Department of Labor has filed a complaint against Premiere Publications, 3520 Roosevelt Boulevard, Middletown, Ohio, alleging violations of the overtime provisions of the Fair Labor Standards Act (FLSA).

The department filed the complaint in U.S. District Court for the Southern District of Ohio, Western Division, Cincinnati. The complaint alleges that the telemarketing firm failed to pay time and one-half pay for work hours over 40 in a week. The violations allegedly occurred since January 1995. The department asked the court to enjoin the firm from future violations of the FLSA.

The Labor Department is seeking back wages of $6,903.71 for seven employees and liquidated damages. Liquidated damages under the FLSA are an amount equal to back wages.

Wage and Hour District Director Richard Malloy in Columbus said that the case exemplifies the Labor Department's efforts to protect the rights of employees and ensure that employers properly pay all employees.

The Wage and Hour Division of the Employment Standards Administration (ESA), U.S. Labor Department, enforces the FLSA. The law sets a federal minimum wage of $4.75 for most workers and generally requires overtime pay for hours worked over 40 in any workweek. The FLSA also requires employers to keep adequate time and payroll records and sets standards for the employment of minors.

The legal action followed an investigation by the Wage and Hour Division, 200 N. High, Rm. 646, Columbus, supervised by Richard J. Malloy, district director.
