CLEVELAND PLANT AND FLOWER ORDERED TO PAY $26,000 BACK WAGES FOR FEDERAL WAGE LAW VIOLATIONS
Also Pays $9500 Civil Money Penalty
Chicago Cleveland Plant and Flower Co., 2419 E. 9th St., Cleveland, has been ordered to pay $26,000 in back wages to 19 current or former employees as a result of violations of the Fair Labor Standards Act (FLSA), which is the federal minimum wage and overtime pay law.
The firm also agreed to pay a civil money penalty of $9,500 assessed by the U.S. Labor Department’s Wage and Hour Division as a result of the firm’s failure to pay overtime compensation to the employees involved. Federal District Court Judge Lesley Brooks Wells ordered payment of the back wages to employees found to be due as a result of overtime pay violations, and enjoined the firm from future violations of the FLSA. The Labor Department has alleged in a complaint filed before the court that the firm failed to pay time and one-half the regular rate of pay for hours over forty in a single work week, and that the firm had failed to keep and maintain adequate records of employees’ wages and hours.
The investigation of the firm was conducted by the Labor Department’s Wage and Hour District Office, 1240 E. Ninth St., Cleveland, under the supervision of District Director Barry Haber.
